BLAKEAWAY is committed to providing quality services to you, and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include names, delivery and billing addresses, email addresses, mobile and other phone numbers, order history, and the delivery postcode or region you select on our website.

We obtain this Personal Information in many ways, including by telephone, by email, in our stores, via our website www.blakeaway.com.au, from media and publications, from other publicly available sources and from third parties. We don't guarantee website links or the policies of authorised third parties.

We collect your Personal Information for the primary purpose of providing our products and services to you (including taking, preparing and delivering your orders), providing information to our customers and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.

You may unsubscribe from our email marketing at any time by using the unsubscribe link in any email or by contacting us in writing. You can opt out of text messages as described in the next section.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Text messaging (SMS)

If you opt in to receive text messages from BLAKEAWAY, we collect your mobile phone number and a record of your consent (including the date, time and method by which you opted in).

We use your mobile number to send you:

• order and delivery updates, such as order confirmations and pickup or delivery notifications
• reminders about items left in your shopping cart
• marketing messages about our products, promotions and events, where you have opted in to receive them

Message frequency varies. Message and data rates may apply depending on your mobile plan.

You can opt out of marketing text messages at any time by replying STOP to any message, or by contacting us at hello@blakeaway.com.au. Reply HELP for help. Opting out of marketing messages will not stop essential messages about an order you have placed.

We send text messages through our messaging service provider, Klaviyo, which processes your mobile number and consent on our behalf solely to deliver our messages. We do not sell, rent or share your mobile number or text messaging consent with third parties for their own marketing purposes.

Cookies and abandoned carts

BLAKEAWAY's website uses cookies and similar technologies provided by our e-commerce platform (Shopify) and our marketing apps to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages by email and, if you have opted in, by text message.

We also use cookies to remember your selected delivery region, keep you signed in, understand how our website is used and improve it. You can disable cookies in your browser settings, but some parts of our website, such as the shopping cart and checkout, may not work properly without them.

Delivery region and location information

We do not track your device's precise location. Instead, we ask you to select your delivery postcode or region on our website.

We use this information to show you only the products we can legally and safely deliver to your area (for example, alcohol and some fresh or perishable items are only available in certain regions), and to calculate available delivery dates and shipping rates. Your selection is stored in a cookie on your device so we can remember it during your visit, and your delivery address is recorded with any order you place.

We do not use this information for any other purpose and do not share it with third parties except our delivery and shipping service providers, who use it only to fulfil your order.

Sensitive information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

We generally do not need to collect sensitive information. If you tell us about a dietary requirement or food allergy so we can prepare your order, sensitive information will be used by us only:

• for the primary purpose for which it was obtained
• for a secondary purpose that is directly related to the primary purpose
• with your consent, or where required or authorised by law

Third parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances, including:

• to service providers who help us run our business, such as our e-commerce platform, payment processors, delivery and shipping providers, and email and text messaging providers, who may only use it to provide those services to us
• to third parties where you consent to the use or disclosure
• where required or authorised by law

We do not sell your Personal Information. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify it. However, most Personal Information is or will be stored in customer records, which we keep for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you and update or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

BLAKEAWAY will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information. To protect your Personal Information, we may require identification from you before releasing it.

Maintaining the quality of your Personal Information

It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that it is accurate, complete and up to date. If you find that the information we have is not up to date or is inaccurate, please let us know as soon as practicable so we can update our records and continue to provide quality services to you.
